1. Introduction

PiGenTek AI is operated by Aniruddha Roy, a sole proprietorship in Ontario, Canada. By creating an account you agree to these Terms. Contact: hello@pigentek.com

2. Eligibility

You must be at least 18 years old. Users under 18 are prohibited even with parental consent.

3. Account Security

One account per user. Do not share credentials. You are responsible for all activity under your account. Notify hello@pigentek.com if you suspect unauthorised access.

4. Payments and Refunds

All prices in Canadian Dollars via Stripe. Fees are non-refundable once production has commenced. Revisions: Free/Single=0, Basic=1, Creator=2, Premium=2. Do not initiate chargebacks without first contacting hello@pigentek.com.

5. Acceptable Use

You must NOT create content that promotes violence, hatred, or illegal activities. Zero tolerance for any content involving minors - immediate permanent termination and referral to authorities. No deepfakes, impersonation, disinformation, or false advertising. No reverse-engineering PiGenTek to build competing products.

Real People and Public Figures: You are strictly prohibited from requesting or generating content depicting the likeness of any real, identifiable individual - living or deceased, and including public figures, celebrities, athletes, and government officials - without that individual's explicit, documented consent, or clear legal authorization to use their likeness. Consent to appear in one context (e.g. a broadcast, film, or public event) does not grant blanket permission for AI-generated depictions. PiGenTek may request evidence of such consent at any time and will decline or remove content where it cannot be confirmed. You are solely and fully responsible for any claim, damage, or liability arising from a request that generates a real person's likeness without proper authorization, including claims of misappropriation, right of publicity, defamation, or trademark infringement from third-party marks (team names, logos, sponsor branding) that may appear alongside such a likeness.

6. AI-Generated Content

Upon full payment you receive a worldwide commercial licence to use Generated Content. No exclusivity or uniqueness guarantee - similar outputs may be generated for other users. PiGenTek does not guarantee copyright ownership. Review content before commercial use.

7. AI Disclosure

You are solely responsible for complying with all AI disclosure and labelling requirements on platforms where you publish Generated Content.

8. Privacy and Data

We collect: Name, email, project briefs, payment records only. We do not sell your data. Videos stored in private Cloudflare R2 for up to 90 days - download your own copies. We do not use your content to train AI models without consent. Governed by PIPEDA and Ontario privacy law.

9. Liability

Service provided as-is. No guarantee of business outcomes, viral performance, or platform acceptance. Liability capped at fees paid in the 12 months preceding any claim. No liability for indirect or consequential damages.

10. Indemnification

You agree to indemnify PiGenTek against claims arising from your use of the Service, your content, or your violation of these Terms.

11. Termination

You may close your account at any time by emailing hello@pigentek.com. PiGenTek may suspend accounts that breach these Terms. Download all content before account closure.

12. Governing Law

These Terms are governed by the laws of Ontario, Canada. Disputes subject to Ontario courts. Nothing in these Terms removes mandatory consumer protection rights under Canadian law.
